Cecilia Abena Dapaah Seeks Injunction Against the Office of the Special Prosecutor

Former Minister of Sanitation and Water Resources, Cecilia Abena Dapaah, has submitted an application to the Human Rights Division of the Accra High Court, requesting an interlocutory injunction against the Office of the Special Prosecutor (OSP). Her aim is to prevent any actions that may adversely affect her rights to a fair trial, protection from deprivation of property, and administrative justice. She requests that this injunction remain in effect until a final decision is reached in the case between herself and the OSP.

These details were outlined in her affidavit in response to the suit raised by the OSP. Initially, Cecilia Dapaah opposed the OSP's lawsuit, pointing out that the re-seizure of her funds, the freezing of her accounts and property were unfair, unreasonable, capricious, arbitrary, and beyond the OSP's powers under Act 959 and the provisions of Articles 23 and 296 of the 1992 Constitution. She urged the court to order the OSP to release her money and unfreeze her account. Furthermore, she requested the court to prohibit the OSP from continuing the investigation against both herself and her husband, Daniel Osei Kufuor.

Cecilia Dapaah's opposition stems from what she considers the OSP's prejudicial and arbitrary conduct since the commencement of the investigations against her. In her affidavit, she states, "I am advised by Counsel and firmly believe, to prevent any further violation of my constitutionally guaranteed rights and to ensure that my application for judicial review remains meaningful, it is crucial that the Respondent is restrained from continuing their investigation until a decision is made on my aforementioned application."

She also emphasizes that damages alone would be insufficient to compensate her if the court does not grant her application for an injunction.

Resorting to legal remedies such as seeking an interlocutory injunction is a common measure individuals undertake to protect their rights and interests during ongoing legal proceedings. The ruling of the court on this matter will determine whether Cecilia Abena Dapaah's prayer for an injunction is granted or not.
