Chief Justice Dismisses Judge For Having Affair With Petitioner

Chief Justice Gertrude Sackey Torkornoo, acting upon a decision by the Judicial Council, has terminated the appointment of Circuit Court judge Alfred Kwabena Asiedu. In a letter dated November 13, 2023, the Chief Justice expounded that her decision was guided by a disciplinary committee report, which substantiated allegations of abuse of power, malicious prosecution, and impropriety against the judge.

The letter, addressing the judge directly, specified the grave nature of the allegations, including abuse of power, sexual exploitation, malicious prosecution, and impropriety, lodged by Singari Diana Sadia on January 16, 2023. The disciplinary committee, convened by the Judicial Council to probe into the allegations, found sufficient evidence that the judge had engaged in an improper relationship with the petitioner, who had a divorce case pending before him. Furthermore, the committee validated the accusation of abuse of power and wrongful prosecution, as it was determined that the judge had instigated the arrest and prosecution of the petitioner without due grounds.

Subsequently, the Judicial Council, in a meeting on October 25, 2023, concluded that the judge's conduct constituted misconduct, unanimously concurring with the dismissal based on Article 151 (1) of the 1992 Constitution. As a result, the termination was executed with immediate effect, and the judge was directed to surrender all official properties, including the official vehicle, dockets, and record books, to the Judicial Secretary. Furthermore, the Chief Justice mandated the prompt removal of the judge's name from the service's payroll through the Director of Human Resources.
